Please read these terms and conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate.

The terms and conditions set out below apply to all participants in the Clarins Promotion conducted on the Clarins South Africa online shop. Please refer to the following website for the current Terms and Conditions for this Promotion: Fly Me To Paris Competition Terms & Conditions

Clarins Promotion ("the Promotion") is conducted by Clarins South Africa (Pty) Ltd (The Promoter), with registration number 2011/115636/07 and principal place of business at The Firs, Corner Biermann & Cradock Avenues, Rosebank, Johannesburg, 2196, South Africa Tel: +2711 809 6300 ("Clarins South Africa").

1. All Participants must:
  • be a natural person and be at least 18 (eighteen) years of age at the date of entry;
  • be a citizen/legal resident of the Republic of South Africa;
  • be in possession of a valid South African Identity Document or passport with a residence/work permit; or
  • reside in South Africa for the duration of the Promotion Period as well as for the period during which the prize draw and the booking of the prize takes place.

2. Employees, directors, prescribed officers, shareholders, members and partners (and their family members) of Clarins South Africa, the applicable advertising company for the competition or any of their holding or subsidiary companies and their advertising and promotions agencies, are not eligible to participate in this competition. Clarins South Africa reserves the right to disqualify any participant who contravenes this rule.

3. The competition will commence on 1st September 2023 and will end on 30th September 2023. No entries received after 23:59 on 30 September 2023 will be considered. The duration of the Promotion may be extended or curtailed at the discretion of Clarins South Africa.

4. The draw date for this promotion is 5th October 2023 where 1 winner will be drawn. The winner will be contacted by Clarins South Africa via email on the email address that they have on their online Clarins South Africa account within 7 days after his/her name has been drawn.

5. The winner will be determined by a random draw and the results are audited by an independent auditor.

6. Should unforeseen circumstances prevent the draw from taking place on the set draw date; the draw will be moved to the next available date.

7. Clarins South Africa’s decision is final, and no correspondence will be entered into. Should the winner not be contactable telephonically within 48 hours, the prize will be transferred to the next randomly selected entry.

8. Proof of eligibility, in the form of a valid South African identity book/resident permit/work permit, as well as proof of address and any other document which may be requested to enter the Promotion, must be provided to Clarins South Africa upon request.

9. Clarins South Africa reserves the right to disqualify anyone entering the Promotion that is not able to provide the requested documentation to Clarins South Africa within 72 hours of the first request for documentation.

10. Mechanics: To participate in this competition, shoppers must purchase any Clarins product online on www.clarins.co.za during the specified period and must subscribe to the www.clarins.co.za newsletter. Each separate purchase between 1st September 2023 and 30th September 2023, provided the shopper has signed up for the newsletter, will qualify as an automatic entry into the draw.

11. Participants in this competition stand a chance to win:
  • TWO return premium economy air tickets from OR Tambo in Johannesburg to Paris – including all relevant airport taxes, up to the total value of R53,000 (fifty-three thousand Rand only)
    • The air tickets will be booked on Air France – as the preferred travel airline partner for Clarins South Africa.
    • The air tickets will be valid for travel between 1 November 2023 and 31 December 2024.
    • The flights will need to be booked and confirmed by 30 June 2024.
    • Travel dates over school holidays or during peak seasons are subject to availability.
    • The flights will need to be booked at least 2 months prior to the departure date.
    • The flights need to be taken for the same travel dates as two passengers travelling together on the same flight and may not be split into two separate flights with different dates.
    • The flights may include stop overs/connecting flights.
    • The winner is to provide 3 separate departure date possibilities so that availability may be checked. Should the desired dates be unavailable, the winner is to provide 3 new dates until a booking can be confirmed. The prize value shall not be increased and should the preferred booking dates exceed the flight price of R53,000 (for the 2 people), alternative dates will be requested or the winner will be requested to pay-in the balance.
    • It is the winner’s responsibility to arrive at the airport on time and no flight bookings will be rescheduled or replaced should the winner and accompanying traveller miss their flights (connecting or international) for any reason whatsoever.
    • Flight tickets are subject to seasonal adjustments and currency fluctuations, at the time of booking.
    • Should travel be restricted after the booking is confirmed, the booking will be moved up to the next available booking date once restrictions have been lifted.
  • A one-hour Spa Treatment for TWO people at a Clarins Boutique in Paris. Clarins South Africa will liaise with the winner on a suitable date and time to book this treatment for while they are in Paris and Clarins South Africa will be responsible for the booking and payment of this treatment and will share these details with the winner.

12. The winner and travel partner are required to have valid Passports. Should they not have valid passports, they are to apply for passports within 72 hours of being notified that they are a winner. The proof of application will be required. Should the winner or travel partner not comply with this term within the 72-hour period, they will be disqualified and the prize will be awarded to the next randomly selected winner.

13. The winner and travel partner will need to apply for the applicable travel Visa (this will be for the winner’s own account). Should the Visa be rejected, the winner will forfeit the prize.

14. The following are not included in the prize and are for the winner’s account:
  • Any costs related to applying for and receiving passports for international travel.
  • Any costs related to applying for and receiving any required travel visas.
  • Any costs related to any medical clearance certificates that may be required.
  • Any PCR tests that may be required.
  • Any costs related to extending the trip to other destinations.
  • Any costs incurred should the air tickets need to be changed once the booking is finalised.
  • Travel costs to and from the departing airport (OR Tambo in Johannesburg).
  • Travel insurance.
  • Accommodation in Paris and any bar tabs, room service, in-room entertainment or mini bar fees charged on departure.
  • Transport/transfers (including airport transfers) while in Paris.
  • Spending money and items of a personal nature.
  • Any additional baggage allowance costs.
  • Any costs incurred while travelling (not included in the flights) are for the winner’s own account and will not be reimbursed.

15. The winner will need to liaise with XL Nexus Travel on (011) 486 9000 or ronelles@nexustravel.co.za to book their flights to Paris. On booking, the relevant Nexus Travel booking terms and conditions will apply and can be reviewed on their website at Nexus Travel.

16. Product images depicting prizes are for illustrative purposes only and may differ from the actual prizes and Clarins South Africa is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.

17. Should a participant/winner provide incorrect contact details or fail to allow Clarins South Africa to contact them during the first 48 Hours from the time that a winner is selected, and should a winner not accept the prize, for any reason whatsoever, the winner will forfeit the prize and Clarins South Africa will select a replacement winner from the qualifying entries.

18. Failure to claim a prize or a refusal or inability to provide required documentation or comply with any of the competition requirements within 72 hours of notification will disqualify the winner and a new winner will be drawn in terms of these rules.

19. No substitution or cash redemption of non-cash prizes is permitted. Prizes are not transferable. Prizes are subject to availability and Clarins South Africa reserves the right to substitute any prize with another of equivalent value without giving notice to participants/winner(s).

20. Clarins South Africa reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of Clarins South Africa’s control. Any changes to the competition will be notified to entrants as soon as possible.

21. Clarins South Africa will not be responsible for any lost, damaged or delayed entries for any reason whatsoever.

22. Clarins South Africa reserves the right to disqualify any claim if fraud, dishonesty or cheating of any nature is suspected on the part of a participant.

23. Clarins South Africa reserves the right to amend these terms and conditions at any time without prior notice.

25. INDEMNITY

  • To the extent permitted by the Consumer Protection Act and any other applicable law:
      a.The participant and/or winner(s) hereby indemnifies Clarins South Africa, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants entrance to the Promotion.
      b.Clarins South Africa excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).
    • Clarins South Africa reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age and place of residence) and to reject any participant who has not complied with these Terms and Conditions. Errors and omission may be accepted at Clarins South Africa’s discretion. Failure by Clarins South Africa to enforce any of its rights at any stage does not constitute a waiver of those rights.
    • Clarins South Africa reserves the right to carry out reasonable due diligence to help ensure that the use of any such person in advertising or publicity for the Promotion will not bring Clarins South Africa or any of Clarins South Africa’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by Promoter in its sole discretion.
    • Neither Promoter nor its agents or distributors will have any liability in relation to this promotion.


    26. DISCLOSURE OF PERSONAL INFORMATION
    • All personal information supplied by a participant shall be processed in accordance with South African data protection legislation and Clarins South Africa’s Privacy Policy.
    • The Participant understands that the personal information given to Clarins South Africa, its associated agencies and the third-party service providers running the Promotion in conjunction with Clarins South Africa will be used by Clarins South Africa for the purposes of:
        a.assessing eligibility for the competition;
        b.contacting winners of the competition; and
        c.drawing reports for statistical purposes.
    • Clarins South Africa may disclose a Participant’s information where it has a legal duty in terms of applicable legislation, the law, or where it may be deemed necessary in order to protect Clarins South Africa.
    • By entering the competition, the Participant agrees:
        a.that he/she has been notified of the purpose and reason for the collection and processing of such Personal Information.
        b.that he/she consents and authorizes Clarins South Africa to collect, process and further process his/her Personal Information, for the purposes as set out in clause 9.1 above.
        c.to make available to Clarins South Africa all necessary Personal Information required for the purpose of facilitating the competition.
        d.to the disclosure of his/her Personal Information by Clarins South Africa to any third party where Clarins South Africa has a legal or contractual duty to disclose such Personal Information.
        e.that Clarins South Africa will collect, store and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform Clarins South Africa in writing should the participant wish to be removed from all communication.
        f.that Clarins South Africa may use names and images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner. All promotional material will become the sole property of Clarins South Africa. However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to Clarins South Africa at Clarins South Africa, The Firs, Corner Biermann & Cradock Avenues, Rosebank, Johannesburg, 2196. Attention: Legal Department. The written notification is to reach Clarins South Africa by no later than the stipulated draw date.
    • Participants have the right to access the personal information that Clarins South Africa holds about them. They further have the right to request that Clarins South Africa updates, corrects or deletes their personal information on reasonable grounds. Once a Participant objects to the processing of their personal information, Clarins South Africa will take all reasonable steps to amend the personal information accordingly.
